Terms of Service

§ 1 Provider and scope

These terms govern the use of Timbre (timbremusic.app and related apps), provided by Dominik Steffan Music, Dominik Steffan, Georg-Schwarz-Str. 169, 04179 Leipzig, Germany.

§ 2 Service

Timbre measures music tracks and provides the results. Use is free within a quota of new analyses (currently 500, 5,000 after e-mail verification). Tracks already in the catalogue do not count. There is no entitlement to any particular availability, speed or accuracy; measurements are automated estimates.

§ 3 Account

An account is required. You must be at least 16 years old, keep your credentials secret and hold only one account.

§ 4 Your music

You only upload files you lawfully own, and only for measurement. Timbre does not permanently store, listen to, distribute or make audio available to anyone.

§ 5 Measurements and shared catalogue

Measurements contain no works and no personal data. You grant the provider a free, perpetual right to store these anonymous measurements in the shared catalogue and provide them to other users owning the same track. If you turn sharing off, this does not apply to analyses created afterwards.

§ 6 Prohibited use

In particular: automated mass querying outside the official apps, attempts to manipulate the catalogue or circumvent quotas (e.g. via multiple accounts), uploading files that are not music, and attacks on the infrastructure.

§ 7 Suspension and termination

You may delete your account at any time. The provider may suspend or delete accounts violating § 6 and may discontinue the service with 30 days' notice.

§ 8 Liability

The provider is fully liable for intent and gross negligence and for injury to life, body or health. For slight negligence, liability is limited to breaches of essential obligations and to typically foreseeable damage. As the service is free of charge, §§ 521, 599 of the German Civil Code apply accordingly.

§ 9 Changes

Changes are announced at least 30 days in advance. If you do not object, they apply from the announced date; the announcement will point this out.

§ 10 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence remain unaffected.
